Policies Form Of Application For Enterprises To Obtain The Use Right Of State-Owned Land. ![]() Paid assignment- The State government assigns the use right of State-owned land to the land user within certain period of years, while the land user shall pay an assignment fee for the land use right. The land user may obtain the land use right through paid assignment, and sign an Assignment Contract with the State Land Administration Bureau. Once all contracted assignment fee is paid, the land registration will be processed with a 'Land Certificate' being drawn. The land-use-right obtained in this way may be transferred, leased out or mortgaged. The maximum term for the assignment of land-use-right is as below: ( 1 ) 70 years for residential purpose; ( 2 ) 50 years for industrial purpose; ( 3 ) 50 years for education, science-technology, culture, public health and sports purposes; (4) 40 years for commercial, tourist and entertainment purposes (5) 50 years for comprehensive or other purposes. Paid transfer: The land user re-transfers the use right of State-owned land in a non-gratuitous way to other land users. A Transfer Contract shall be signed for land-use-right transfer. The land-use-right obtained in this way shall have a term equal to the remaining years by deducting the used term from the assigned term. Procedures For An Enterprise To Obtain Land-Use-Right The land administrative dept is to synthesize the opinions of the related planning, development and reform, and environment protection departments, and to work out the implementation program for assigning the land, then it is to publicize the announcement after submitting the program to the government and obtaining the approval; the enterprise is to undergo the project examination and approval document according to the content of the announcement (examination for approval, and getting registered on file), and to participate the State-owned land bidding invitation, auction and quoted assignment activities held by the land administrative dept to get the State-owned land use right, and to sign the State-owned land use right assignment contract; after paying the land assignment amount and other fees, the land user is to undergo land registration procedures according to provisions, and to drav~ the " State-owned Land Use Certificate " . Land-Supply Conditions for Construction Projects For project-used land, an index doubly-controlling policy is exercised, in which the land used for industrial projects shall be allocated with the land resources according to investment strength, and the ratio between enterprise investment and registered capital shall not exceed 3: l. The investment strength of an industrial project,used land shall not be lower than RMB 4 million yuan to a mu for the project-used land in a State-level development zone, shall not be lower than RMB 3.2 million yuan to amu for the industrial project-used land in a provincial level development zone, and shall not be lower than RMB 2 million yuan to amu for the industrial project-used land in a zone where rural industries are concentrated. The registered capital of a domestic project that has passed the antecedent examination of the district shall not be lower than 2 million yuan/mu, the registered capital of a foreign-funded project shall not be lower than 300,000 USD standard. With regard to all the projects with a total investment lower than RMB 10 million yuan and with a used land less than l 0 mu, no land will be provided for any single case alone. |
